The grievance of the petitioner in the aforesaid petition is that the respondent nos.2 and 3 are carrying out investigation illegally without Digitally signed by RAJESHRI PRAKASH AHER Date:

2022.08.02 11:46:34 +0530 taking permission of the Learned Magistrate, Pune, in connection with RAJESHRI PRAKASH AHER C.R.No.11 of 2016, registered with Vadgaon - Maval Police Station, Pune.

rpa 2/2 17 wp 2589 of 2022.doc Learned APP submits that the grievance made by the petitioner in the petition is baseless, inasmuch as, the police had filed an application under Section 173(3) of Cr.P.C., for carrying out further investigation and that the same was permitted by learned Magistrate, Pune. In view of the aforesaid statement made by the learned APP, learned counsel for the petitioner does not press this petition and seeks leave to withdraw the same.
