IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 9391 OF 2015 Aakash Raju Sakat ..

Petitioner vs.

Mrs. Kiran A. Sakat ..

Respondent Ms Bhagyalaxmi Richa for Petitioner.

CORAM : M. S. SONAK, J.

DATE: 23 SEPTEMBER 2015 P.C. :- 1] Not on board. Upon production, taken on board. 2] Heard the learned counsel for the petitioner. 3] The challenge in this petition is to the order dated 21 April 2015, by which the Trial Court has directed the petitioner to pay interim maintenance at the rate of Rs.3,000/- to the wife and Rs.2,000/- to the minor daughter.

4] Upon hearing the submission made by the learned counsel for the petitioner and upon perusing the record, in my judgment, there is no jurisdictional error in the making of the impugned order. In paragraph 2 of the impugned order, the Trial Court, has discussed the relative financial position of the parties. The interim 1/3

order is neither disproportionate nor exorbitant in the facts and circumstances of the present case. Besides, this is only an interim award.

5] Accordingly, there is no case made out to interfere with the impugned order. This petition is dismissed. There shall be no order as to costs.
