The learned counsel for respondent nos.1 and 2 has invited attention to the order dated 28th April 2010 passed in Civil Application No.40 of 2010. It has been observed in the said order that the petitioner having resigned from services, the prayers made in the civil application had become infructuous.

Considering the nature of relief sought in the writ petition, it is clear that the cause for prosecuting the writ petition now does not survive with the resignation of the petitioner.
