In this Revision Application, the order dated 5th April, 2018 passed by the Designated Judge under Protection of Children from Sexual Offences Act, Greater Bombay rejecting the prayer of recalling PW-1 prosecutrix for further cross-examination in POSCO Special case no. 491 of 2014 is challenged.

I have considered the submissions made by the learned counsel for the applicant/accused and also the learned APP. Perused the orders passed by the learned Designated Judge under POSCO. In all fairness, the prosecutrix is to be recalled for

515.APL772_2018.doc further cross-examination. On 22nd November, 2018, the counsel for the accused will cross-examine further and after completion of the evidence of prosecutrix, he will cross-examine PW-2. Learned APP and the learned counsel for the accused shall cooperate the designated Court.

Criminal Application is allowed and is disposed of accordingly.
