Heard learned counsel for the applicant.

The learned Counsel for the applicant submits that by this civil application, applicant is seeking to bring the legal heirs on record of sole petitioner-Jawaharlal Sitaram Agarwal who died on 03.05.2018. The learned Counsel for the applicant submits that the present civil application was filed on 07.07.2018 i.e. within time. Hence, applicant be permitted to carry out the amendment in CRA No.146 of 2018 for bringing legal heirs on record of deceased sole petitioner. 3.

Considering the submissions made by the learned Counsel for the applicant, avernments made in civil application and the civil application filed within time, I am satisfied that the applicant has made out case for following order :- S.C.Magar

11-cac-498-2018.doc a) Applicant is permitted to bring legal heirs on record of decased sole petitioner Jawaharlal Sitaram Agarwal in CRA No. 146 of 2018 on or before 22.12.2018, failing which the civil application stands dismissed.

b) If amendment is carried out within stipulated time, applicant is directed to serve the amended copy of CRA No. 146 of 2018 on the other side immediately thereafter. c) Civil application stands disposed of.
