1] Heard the learned counsel for the Applicant.
2] The appellant was tried by Additional Sessions Judge for the offence under Section 307 of the Indian Penal Code. However, the learned Additional Sessions Judge, Vaduj found him guilty for the offence punishable under Section 326 of the IPC and sentenced him to suffer S.I. for 3 years with fine of Rs.5000/- and also convicted him for the offence punishable under Section 323 of the IPC and sentenced to suffer S.I. for one year with fine of Rs.1000/-. 1/2
(4)IA-2382-2022.doc 3] Considering the quantum of sentence and that the Appeal is not likely to come up for hearing in near future, I am inclined to suspend the sentence. Hence, order :
a] Substantive sentence passed against the Applicant is suspended till disposal of the Appeal.
b] The Applicant be released on PR Bond of Rs.15,000/- with one solvent surety in the like amount.
c] Interim Application is disposed off.
