1] Bail Application No.58/2021 was withdrawn before this Court. When disinclination was expressed to entertain the Application, withdrawal was sought through Advocate Ms.Gayatri Gokhale, who represented the Applicant.

Admittedly, within a few days, and to be precise on 26.08.2021 the present Bail Application is filed without disclosing that the Bail Application filed by the same Accused was withdrawn before this Court on 04.08.2021, which amounts to suppression of essential fact and this itself do not make the Applicant entitled to be heard. 1/2

(1)BA-3042-2021.doc 2] Apart from being no change in circumstance, the new counsel again appeared and pressed the present Bail Application through earlier counsel on record Ms.Gayatri Gokhale, without making disclosure about the order dated 04.08.2021.

Necessarily the Applicant who is trying to take chances with the Court, cannot be indulged at all.

3] The learned counsel for the Applicant fairly state that there is suppression in the Application and since he was subsequently engaged by the Applicant, he can add nothing more, but place correct facts.

In the wake of above, Bail Application is rejected. Interim Application is also disposed off.
