At the outset, learned A.P.P states that five witnesses have been examined.

Learned Counsel for the applicant does not dispute the same, however, he submits that the main witness has not come to depose before the trial Court. He submits that the trial has not proceeded after 3rd April, 2017.

Considering the fact that the trial has already commenced, it is not necessary to go into the merits of the application. Application is SQ Pathan 1/2
ba.1598.17.21.doc accordingly disposed of with a direction to the trial Court to decide the case as expeditiously as possible and in any event, within 6 months from the date of receipt of this order.
