Heard learned Counsel for the parties.

By this application, the applicant seeks pre-arrest bail in connection with C.R. No. I-116 of 2017 registered with the Nandgoan Police Station, Nashik, for the alleged offences punishable under Sections 306, 506 r/w 34 of the Indian Penal Code.

Learned Counsel for the applicant states that the deceased -
2/3 Mahesh Dilip Shewale committed suicide on 15th June, 2017. He submitted that in the chit, which was found in the pant pocket of the deceased, the applicant has not been named. He submitted that it appears that in the suicide note, deceased - Mahesh has mentioned the names of the Sarpanch of Palashigoan, Mr.Ashok Pandurang Sangle and one Avinash Dada Shewale.

Learned APP has tendered the suicide note of deceased - Mahesh.

Perused the papers. The complainant is the uncle of deceased - Mahesh. It appears that deceased - Mahesh committed suicide on 15th June, 2017 in his agricultural field. A suicide note was found in the pant pocket of deceased - Mahesh. In the said suicide note deceased - Mahesh has disclosed the names of the Sarpanch of Palashigoan, Mr.Ashok Pandurang Sangle and one Avinash Dada Shewale, as being the persons responsible for him committing suicide. He has not named the present applicant.

Considering the aforesaid, the application is allowed and the applicant is granted pre-arrest bail on the following terms and conditions :
ORDER
(i) In the event of the arrest, the applicant be enlarged on bail on executing P.R. Bond in the sum of Rs.10,000/- with one or two sureties in the like amount ;
(ii) The applicant shall report to the Investigating Officer of the concerned Police Station as and when called, till the filing of the charge-sheet or for a period of three months from today, whichever is earlier.

The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the observations made herein are prima facie and are confined to this application.
