Criminal Interim Application No.2410 of 2023 is not on board, taken on board and heard along with Criminal Writ Petition No.5135 of 2022.

Learned APP raises a preliminary objection. She states that the reliefs sought for in the aforesaid petition are general and that the petitioner ought to have filed a PIL.

In view of the preliminary objection raised by the learned APP, the learned counsel for the petitioner seeks leave to withdraw this petition with liberty to file a PIL seeking the same reliefs, as sought for in this petition, as per the Rules framed by this Court for filing a PIL. 4.

Petition is accordingly disposed of as withdrawn with liberty as prayed.

We make it clear that we have not gone into the merits of the petition and as such all contentions of all parties are kept open. 6.

In view of the aforesaid, the Interim Application being Interim Application No.2410 of 2023, does not survive and the same is also disposed of.
