Learned counsel for the Appellant submitted that, against the impugned Order a substantive Petition under Article 227 of the Constitution of India is maintainable and the present Second Appeal has been inadvertently filed. He therefore seeks leave to withdraw the present Appeal with liberty to file a substantive Petition impugning the said Order herein. 2.

Mr.Joshi, learned counsel for the Respondent Nos.1 to 3 has no objection for the same.
