The applicant is seeking bail in CR No.122 of 2015 resisted with Pydhonie Police Station, Mumbai under Sections 370, 370(A), 376, 363, 343, 344, 120-B of the Indian Penal Code. The learned Counsel for the applicant submits that the coaccused Dilip Ramchandra Salvi has been released on bail by this Court by its order dated 24.11.2015. He submits that the principle of parity is applicable to the present applicant as the role attributed to the said coaccused is identical to the applicant in the present application including the antecedents mentioned by the learned APP.

2/2 ba.1408-2015 The learned APP with utmost fairness at her command submits that the applicant in the present application deserves to be released on bail on the ground of parity.

In view of the above, the applicant can be released on bail pending trial. Hence, the following order:

(i) The applicant be released on bail on his furnishing PR bond of Rs.1 lac with one solvent surety in the like amount. (ii) After release on bail, the applicant shall attend the Pydhonie Police Station, Mumbai on every Monday between 10 a.m. to 12.00 noon. (iii) The applicant shall deposit his passport with the Pydhonie Police Station, if he so possesses.

(iv) The applicant shall not tamper with the the prosecution evidence and/or influence the prosecution witnesses.
