This is an Application under section 439 filed by the aforesaid Applicant who is facing trial in Sessions Case No.2067/2019 pending on the file of Addl. Sessions Judge, City Civil & Sessions Court, Greater Bombay for offences punishable under sections 489(B), 489(C) r/w. 34 of the Indian Penal Code.

Heard Mr. Priyatosh Tiwari, learned counsel for the Applicant and Ms. Rutuja Ambekar, learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties.

The aforesaid crime was registered against the Applicant pursuant to the FIR lodged by Deepak Jairam Chavan, Police Head Constable. The case of the prosecution is that the Applicant and the coaccused were found in possession of counterfeit notes of Rs.64,000/-. Learned APP has stated that the trial has already commenced. She further states that the trial will be concluded within a period of four months.

Considering the said statement and also considering the fact that the Applicant is otherwise a resident of Jharkhand, he may not be available for trial, if released on bail, in my considered view, the Application can be disposed of by giving directions to the Trial Court to conclude the trial within specified time. Hence, the Trial Court is directed to conclude the trial in four months and in the event the trial is not concluded within four months, the Applicant is at liberty to file fresh Application before this Court.
