DATED : 12th OCTOBER, 2017.
P.C.
1] Heard learned counsel for the petitioner and respondent. 2] This petition is filed challenging the order dated 15.12.2014, passed by the 3rd Jt. Civil Judge Senior Division, Satara in MP No.352 of 2013 on the application Exh.16. The said application was filed by respondent wife claiming the expenses and the cost of litigation. At the time of filing application, it was brought to notice of trial Court that under the provisions of Protection of Women from Domestic Violence, in Application bearing No.116 of 1/2
3 WP 7271 OF 2015.odt 2012, the Court of J.M.F.C. Saswad has granted interim maintenance of Rs.6,000/- per month to the petitioner wife and her son. 3] Hence, this application filed before the trial Court at Exh.16 was confined only towards litigation expenses. The trial Court has accordingly considering the fact that the petitioner is residing at Saswad and the proceeding for divorce are pending, at Satara, awarded an amount of Rs.3,000/- towards litigation expenses. In my considered opinion having regard to the amount which is granted as expenses and cost of litigation, no interference is warranted in the said order.
4] The petition holds no merit and hence stands dismissed. (DR. SHALINI PHANSALKAR-JOSHI, J.) 2/2
