The grievance of the Petitioner is that the fourth Respondent has raised some unauthorized and illegal construction and for that notices dated 8th March, 2018 and 21st March, 2018 were issued to Respondent No. 4 under Section 53(1) and 54 of the Maharashtra Regional Town Planning Act, 1966 by the Municipal Council. However, no further steps after issuing notices has been taken and construction is going on.

The learned counsel for Respondent Nos. 2 and 3 has filed reply and stated that appropriate action has already been Vishal Parekar 1/2
23-wp-7683-2018.doc initiated against the fourth Respondent in regard to the said unauthorized and illegal construction. It has been stated that the said action will be taken to its logical end as expeditiously as possible.

The learned counsel for Respondent No. 4 on instruction submits that the allegation levelled by the Petitioner as also by Respondent Nos. 2 and 3 in their notices are not correct and Respondent No. 4 will be defending the said notices in accordance with law.

Keeping in view the submissions made by the learned counsel for the parties, we dispose of this Petition by directing Respondent Nos. 2 and 3 to take the said notices issued to Respondent No. 4 to its logical end and decide the controversy as expeditiously as possible preferably within two months from the date of receipt of copy of this order.

The Petition is disposed of as such.
