The petitioner is challenging order of rejection of return of property which was the muddemal in R.C.C. No.142 of 2009.

Learned APP for Respondent No.1-(State) has pointed out against the judgment and order dated 18th February 2021, passed by learned Judicial Magistrate, First Class, Shahapur, District Thane in R.C.C. No.142 of 2009, the State has filed Appeal before the learned Sessions Court bearing Criminal M. A. No.1 of 2022.

In that view of the matter, petitioner is permitted to move appropriate Application before the learned Sessions Court for return of property. If such Application is filed before the
