By this petition, under Article 227 of the Constitution of India, petitioner is challenging the oral judgment dated 13.12.1996 passed by learned Presiding Officer, State Transport Appellate Tribunal, Maharashtra State, Mumbai in Appeal No.12 of 1996 directing petitioner to grant special permit to the respondent on or before 31.1.1997 in respect of passenger Bus No.MH 15-B-9725 in accordance with sub sec.8 of sec. 88 of the M.V. Act, 1988 read with sect.3, Notification dated 31.08.1991.

The learned A.G.P. on instructions from his client who is present in court makes a statement that in view of subsequent development, nothing survives in the present Writ Petition. He submits Mohite 1/2

204 wp759-97 that he received instructions from his client to withdraw the Writ Petition. To that effect, he has given in writing. Same is taken on record and marked "X" for its identification. Same is accepted. 4.

Rule discharged.
