1) The learned APP. on instructions submitted that in pursuance of the directions issued by this Court the applicant has attended the Investigation Officer on stipulated dates.

2) The applicant in the present application has taken a plea of alibi. The learned APP. has produced before me a report dated 14.9.2016 sent by the Police Inspector, Tilak Nagar Police Station, Mumbai who is the Investigating Officer in the present crime stating that prima facie it appears that there is substance in the plea taken by the applicant and there are no eye witnesses to the alleged crime. It is further stated in the said report that during the course of investigation it is revealed that the applicant was not in Mumbai at the relevant time. In view of the

2 /2ABA-1203-16-29 above, the interim relief granted by an order dated 20.7.2016 is hereby confirmed. Application is accordingly allowed.
