IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL BAIL APPLICATION NO.1413 OF 2015 Nitin Narayan Navale .. Applicant

Versus

The State of Maharashtra .. Respondent --- Mr.Satish B. Sakat, Advocate for the applicant. Mrs.S.Gajare-Dhumal, APP for the Respondent State. --- CORAM : ABHAY M. THIPSAY, J.

DATED : 4th AUGUST, 2015 --- P.C. :

Heard Mr.Satish Sakat, learned counsel for the applicant. Heard Mrs.S.Gajare-Dhumal, learned APP for the State. The learned APP submits a report stating that the trial has already commenced, and that the evidence of the First Informant has already been recorded.

I find that while rejecting the applicant's application for bail by an order dated 29th April 2013 (Criminal Bail Application No.568/13) this Court had granted liberty to the applicant to apply afresh for bail in the event of the trial not being over within a period of six months from the date of the said order. However, the applicant did not apply for bail after the expiry of the stipulated period. Apparently, he has applied only after the trial has commenced.

Tilak 2/2 (901)BA-1413-15 Under the circumstances, I am not inclined to release him on bail.

Application is rejected.
