The Petitioner borrower is aggrieved by the action taken by the Respondent-secured creditor under the provisions of SARFAESI Act. Inspite the law laid down and repeatedly reiterated that the remedy to question the actions of the secured creditor under the SARFAESI Act is to approach the Debt Recovery Tribunal (for short "DRT") under section 17 of the Act, yet writ petitions are being filed. This is one more petition.
