By this petition under Article 227 of the Constitution of India the Petitioner org.defendant is challenging the order dated 8.6.2016 passed by Joint Civil Judge, Senior Division, Panvel below Exhibit-1 and 31 in Special Darkhast No.17 of 2013 holding that the objection petition filed by defendant is not maintainable.

After arguing for some time, the learned counsel for the petitioner after taking instruction Mohite 1/2

pr25 wpst19893-16 from petitioner seeks permission to withdraw the petition with liberty to move in Appeal No.254 of 2012. To that effect he has given in writing on farad. Same is taken on record and marked 'X' for identification.

The learned counsel for the respondent makes a statement that till 28.7.2016 they will not take any coercive action against the petitioner. Statement is accepted. Hence, following order is passed:

Writ Petition stands dismissed as withdrawn with liberty as prayed.
