1) This is the second application for bail. The earlier application preferred by the applicant who is accused in CR No.113/14 registered with Malad Police Station, Mumbai under Sections 304B, 306, 498A read with 34 of the Indian Penal Code was rejected by this Court by its order dated 10.12.2015.

2) After hearing the learned counsel for the applicant in this application at length when this court was not inclined to grant any relief the learned counsel for the

2 /2 applicant on instructions seeks leave to withdraw the present application with liberty to file a fresh application for bail before the trial court if the trial arising out of CR No.113/2014 registered with Malad Police Station, Mumbai pending on the file of Additional Sessions Judge, Dindoshi does not conclude within a period of one year from today. 3) The record reveals that the applicant was arrested in the aforesaid crime on 15.3.2014 and since then he is in Jail. That, the charge in the case is not yet framed. As the applicant is in jail since 15.3.2014 the Additional Sessions Judge ceased of the trial arising out of CR No.113/2014 registered with Malad Police Station, Mumbai is requested to expedite the trial and to make an endeavour to conclude the same within a period of one year from today.

4) Application is disposed off in the aforesaid terms.
