Heard the learned Counsel for parties. Perused the contents of the application. Also perused the judgement of the Motor Accidents Claim Tribunal. In the circumstances of the case, we permit the respondent No.1 to withdraw a sum of Rs.30 lakhs for the respondent No.1 herself and her two minor children. The respondent Nos. 4 and 5 are permitted to withdraw a sum of Rs.5 lakhs each.

YBG caf4042-14 The respondents are not liable to furnish solvent surety or security for the withdrawal of this amount. The balance amount should be placed in fixed deposit of a nationalised bank initially for a period of three years and the same should be renewed thereafter from time to time till the disposal of the first appeal. The Civil application is allowed in the aforesaid terms and disposed of.
