IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 8582 OF 2013 Govind Sitaram Ranjankar ..

Petitioner vs.

Vidhyadhar B. Prabhu & Ors.

..

Respondents Mr. D. A. Patil i/b. Mr. Milind Parab & Ass. for Petitioner. Ms P. S. Cardozo - AGP for Respondent No. 11. CORAM : M. S. SONAK, J.

DATE: 28 JANUARY 2015 P.C. :- 1] The records indicate that despite several opportunities, the petitioner took no steps to serve the respondent nos. 2 to 8. Accordingly, the petition has already been dismissed as against the respondent nos. 2 to 8, who are the contesting respondents. Even today, time is being applied for in order to take steps to set aside the dismissal of the petition against the respondent nos. 2 to 8. 2] It appears that the petitioner is not interested in pursuing the matter with diligence. In such circumstances, it will be appropriate to dismiss this petition for non prosecution.

3] The dismissal of this petition for non prosecution, will however not come in the way of the petitioner to apply for restoration, after furnishing appropriate cause, including in the matter of dismissal of the petition as against the respondent nos. 2 to 8 by order dated 7 October 2014. Such an application as and when made, will be considered in accordance with law. Subject to the aforesaid, the present petition is dismissed for non prosecution. (M. S. SONAK, J.) Chandka 1/1
