Mr. K.S.Bapat, learned counsel for the Petitioner and Mr. N.M.Ganguli, learned counsel for Respondent No.1 jointly state that the dispute in these Petitions has been settled between the parties and the application to that effect was filed before the Industrial Court at Mumbai bearing Application No. 105 of 2009 in Complaint (ULP) No. 6 of 1999. The Respondent has paid an amount of Rs. 6,88,770/- in full and
final settlement. A Copy of the application as made before the Industrial Court alongwith the 'Payment Receipt' as tendered by Mr.Bapat is taken on record and marked "X" for identification.

It is stated that the Industrial Court has also disposed of proceedings in view of the settlement. Accordingly counsel for the parties submit that these Petitions have become infructous.

Mr. Bapat, learned counsel for the Petitioner submits that as per the interim order passed by this Court in both these Petitions, the amounts as directed in the said orders were deposited by Petitioners in this Court and the same are invested in fixed deposits. It is submitted that, the amounts be permitted to withdrawn by the Petitioner. Mr. Ganguli has no objection for withdrawal of the amounts by the Petitioner. 4.
In the circumstances, the Petitioner is permitted to withdraw the amounts as deposited by it in both the Writ
Petitions alongwith accrued interest. The office is directed to take necessary steps to enable the Petitioner to withdraw the amounts with interest accrued thereon.

Accordingly, these Petitions having become infructous are disposed of. No costs.
