Though Respondent Shilpa Ganesh Kharade is duly served, no one appeared on behalf of her when the matter was called out.

By this Civil Application, Applicant husband is seeking condonation of 27 days delay in fling First Appeal challenging the judgment and decree dated 31.01.2019 passed by Family Court No.1, Pune in P.A. No.1268 of 2015 dismissing Applicant's petition for divorce under section Mohite 1/2

7 cam221-19.odt 13(1)(ia) of the Hindu Marriage Act, 1955. Inspite of service, no one appeared on behalf of Respondent. Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, we are satisfed that the Applicant has made out a case for allowing the Application. Hence, following order is passed:

a.

Delay in fling Family Court Appeal is condoned. b.

Applicant to remove all offce objections in Family Court Appeal (ST) No.17976 of 2019 on or before 01.02.2020, failing which same shall stand dismissed without referring back to the court.

c.
