1. Called for final hearing. On behalf of the petitioner learned counsel states that the Advocate for the petitioners has not received any instructions. This matter was listed for final hearing on 5 th June, 2017 and 8 th June, 2017.

On both dates none appeared for the petitioners.

2. The record indicates that on 7 th January, 2016 when these two petitions were listed along with Writ Petition No. 1938 of 2004 and Writ Petition No. 2143 of 2001, this Court recorded a statement of counsel for the parties that companion writ petitions have been withdrawn since dispute had 1/2

209-wp-2281-2001.odt been settled. On that basis counsel for the petitioner took further time to consider withdrawal of these matters. However, no further instructions have been received. In the circumstances it appears that petitioner is no longer interested in prosecuting these petitions. Accordingly, I pass the following order :

(i) Writ Petitions are dismissed.

(ii) In view of the disposal of the petitions Civil Application does not survive. The Civil Application is also dismissed. (A.K. MENON,J.) 2/2
