P.C:- The learned AGP has tendered a letter dated 28th March, 2019 addressed by the Section Officer of the Higher and Technical Education Department of the State Government to the Director of Higher Education, Maharashtra State, Pune. It records that the entire tender process which was the subject matter of this Petition has been cancelled. As the tender process has been cancelled, the only relief which claimed in this Petition cannot be granted unless there is a challenge to the cancellation of the tender process.

We, therefore, dispose of the Petition. However, it will be always open for the Petitioner to file a fresh Petition for challenging the decision taken to cancel the tender process and to seek appropriate reliefs therein.

The Petition is accordingly, disposed of. All contentions on merits are kept open.

Issue of legality and validity of the decision taken by the State Government is also kept open.
