DATED : 30th MARCH 2023 P.C:- By order dated 30/12/2020, the appellants were granted protection from arrest subject to compliance of certain conditions.
The interim order continue to operate till date. The learned APP on instructions of the Investigating Officer state that the investigation is now complete and the custodial interrogation of the appellants is not necessary. In the wake of the aforesaid statement, the order dated 30/12/2020 is made absolute. It is expected that the Investigating Officer shall file the charge-sheet within a period of 4 weeks from today.
The learned counsel for the respondent no.2 vehemently oppose the appeals, but despite his opposition, in the wake of the fact that the interim protection is operating since last more than 2 years and in the wake of the statement made by the learned APP on instructions of the Investigating Officer, I deem it appropriate to confirm the order dated 30/12/2020. Appeals are allowed in aforesaid terms.
