Learned APP has submitted that as on today, the prosecution has examined two panch witnesses and examination-in-chief of the completed and the next day for cross-examination of the complainant is 14/3/2022. In view of this, learned Sessions Judge shall make an endevour to conclude the trial by 31st December, 2022. The present application is filed only on the ground that there is a delay in trial and therefore, according to the learned Counsel for the applicant, the applicant is entitled to grant of bail. 14.BA3092.2021.doc would not be appropriate to grant bail to the principal accused in the offence punishable under section 302, 307, 326, 324, read with section 34 of the Indian Penal Code in the midst of the trial. The gravity of the offence and repercussion on the society also need to be taken into consideration. Hence, the application stands rejected and disposed of accordingly.
