The learned Additional Public Prosecutor Mrs. A S Pai states that the provisions of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999, (for short MPID Act) has been invoked in view of the fact that the gravamen of the allegation against the Petitioner is that he has duped a large number of investors which number during the course of the investigation is found to be 34 at present who are duped to the tune of Rs.Three Crores Seventy Lakhs Seventy Four Thousand. She further states that the investigation is ongoing. In view thereof, we do not find this a fit case to exercise our jurisdiction under Section 482 of the Criminal Procedure Code having regard to the relief sought viz challenging the application of the provisions of the MPID Act. Hence no relief can be granted to the Applicant. The above Criminal Application is accordingly dismissed.
