This is an application under Section 439 of Code of Criminal Procedure, 1973 for bail.

The applicant came to be arrested in Crime No. 801 of 2019 registered at Hadapsar Police Station, for the offences punishable under Sections 302, 506(2) read with 34 of the Indian Penal Code, Section 3(25) of the Arms Act and Section 3, 7 of the Criminal Law Amendment Act.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State.

The learned counsel for the applicant has placed on record A. J. Vallakati 1/2

10-BA-2188-22.doc copy of the orders passed by this Court dated 21 October 2020 in Criminal Bail Application (St) No. 2497 of 2020 and dated 12 March 2021 in Criminal Bail Application No. 417 of 2021. By the said orders this Court has released the co-accused on bail. The learned counsel for the applicant submits that allegations against the said co-accused are more serious than the allegations against the present applicant. 5.

I have perused the charge-sheet and orders passed by this Court. There appears to be substance in the submission of the learned counsel for the applicant. I am, therefore, inclined to release the applicant on bail. In the result, following order is passed:

ORDER

A) The Application is allowed.

B) The applicant be released on bail in Crime No. 801 of 2019 registered at Hadapsar Police Station, for the offences punishable under Sections 302, 506(2) read with 34 of the Indian Penal Code, Section 3(25) of the Arms Act and Section 3, 7 of the Criminal Law Amendment Act, on furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C) The applicant shall attend the concerned Police Station once in a month, i.e. on first Saturday between 11.00 a.m. to 2.00 p.m., till conclusion of the trial.
