The subject appeal arises out of an order of conviction under Section 302 of the Indian Penal Code, 1860. Otherwise also, the applicant has explained the delay by making an averment in paragraph 3, we, therefore, condone the delay of 94 days occurred in filing the aforesaid appeal. The criminal application is, accordingly, disposed off.
