Perused the prayers made in this application. The Applicant - husband is the Appellant in the Family Court appeal. The challenge in the Family Court Appeal is confined to dismissal of the Petition filed by the Applicant for judicial separation under Section 10 of the Hindu Marriage Act, 1955. The reliefs which are sought in this application cannot be granted in the present Family Court Appeal. Hence, we dispose of the application by permitting the Applicant to adopt appropriate proceedings in accordance with law. All contentions on merits are kept open.
