Heard learned counsel for the Applicant, on instructions, seeks leave to withdraw this application with liberty to file application for bail on medical conditions of the Applicant. 2.

Considering the submissions of learned counsel for the Applicant, the Application is allowed to be withdrawn with liberty to file Bail Application and disposed of.

Learned counsel further submitted that this Court (Coram: M. S. Karnik, J) by order dated 1st November, 2023 has directed to 1/2

Gayatri Shimpi 53-ABA-1817-2023.doc prison hospital to give proper medical treatment to the Applicant and, if required to take the Applicant to J. J. Hospital but said order has not been followed.

Considering the submissions of learned counsel for the Applicant and the order passed by this Court (Coram: M. S. Karnik, J) vide order dated 1st November, 2023, the Superintendent of Prison Kalamba, Kolhapur Central Prison is directed to give proper medical treatment to the Applicant and, if required he be taken to J. J. Hospital, Mumbai and submit report to this Court in that regard. 5.

The Application is disposed of.
