After hearing learned counsel for the parties, we regret to note that no relief can be granted to the petitioner on account of vague pleadings in the writ petition. As per the petitioner, he was employed as a teacher by Mook-Badhir Nivasi Vidyalaya. Whether the institution is an aided institution or not? Nothing has been pleaded. Whether there is any legislation covering the field of
2/2 10-wp-11285-16.doc entitlement of employee of aided institution to be absorbed on closure? None has been pleaded. Case pleaded is that the school was suddenly closed down in October 2013. Prayer made in the writ petition is to pay wages to the petitioner from November 2013 with a direction that the school should be restarted. 2.
On what fact or law the petitioner claims the school to be restarted has not been pleaded. Counsel for the petitioner states that the petitioner has been given employment in some other school. Which school it is? Counsel has no information. 3.
We reject the petition as not maintainable on account of actionable averments not being made. Meaning thereby, the petitioner would be entitled to revisit the court by making proper averments if petitioner desires to once again approach this court. File be consigned to record room.
