The prayer for bail made by the chargesheeted accused of Kastruba Marg police station as a result of C.R. No. 15 of 2014 for the offences punishable under Sections 307 and 326 read with 34 of Indian Penal Code though vehemently objected by the learned APP on the ground that injury certificate shows that the victim has sustained a fracture, having due regard to the nature of material collected against the applicant i.e. 1/3
F.I.R. lodged on suspicion, even the victim having not named the applicant, the involvement of the applicant resting upon the statement of sole eye witness recorded after about two days after occurrence of the incident, the offence is not exclusively punishable with death or imprisonment for life and the facts not showing any particular circumstances for not exercising discretion in favour of grant of bail in such type of offence, the application is allowed.

The applicant is hereby directed to be released on bail upon executing a P.R. Bond in sum of Rs. 50,000/- (Fifty Thousand) with one or two sureties of like amount subject to conditions of the applicant (a) not entering the area of Kasturba Marg police station (b) informing his place of abode to the investigating officer (c) attending the local police station on every Monday and Thursday in between 5.00 pm to 7.00 pm until 2/3
further order (d) not directly or indirectly making any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him/her from disclosing such facts to the investigating officer and (e) not misusing the protection granted by this order for fleeing away or for any other oblique purpose. Application stands disposed of.
