2] Applicant is seeking pre-arrest bail in C.R. No.254 of 2022 registered with Peth-Vadgaon Police Station, Kolhapur for the offence punishable under Sections 420, 504, 506 read with Section 34 of the IPC and under section 12(a) of the Maharashtra Prevention of Gambling Act.

3] The case of the complainant is, receipt of the amount by the Applicant in online business and not honouring the further commitment.

4] Contentions Mr. Joshi, learned Counsel for the Applicant are, 1/2

20 ABA-1984-22.doc Applicant is not the person who is named in the offence and Applicant is not at all benefited financially.

5] Learned APP has demonstrated from investigation papers that Applicant has not only received the amount in his Account but on number of occasions also received amount from Accused No.1. As such, said material sufficiently implicates the Applicant in the offence in question. As the Applicant is unable to explain the aforesaid transactions, inference has to be drawn about involvement of the Applicant in the crime in question. As such, Application stands rejected.
