The Learned Counsel for the petitioner, upon instructions, seeks leave to withdraw the petition with liberty to file appeal. The learned counsel however expresses apprehension about limitation period. Needless to state that since the petitioner has bonafidely filed petition before this court, the petitioner would be entitled for seeking condonation of delay under Section 14 of the Limitation Act. 2.

Leave with liberty as prayed for is granted. Petition is dismissed as withdrawn.
