The appellant was prosecuted along with one Ashok Hathwalne in CBI Special Case No.20 of 1998. The learned Special Judge, after holding a trial, acquitted the said Ashok Hathwalne, but convicted the appellant of offences punishable under section 420 of the IPC and 471 of the IPC. The learned Judge sentenced the appellant to suffer Rigorous Imprisonment for two years and to pay a fine of Rs.10,000/- with a default sentence , on each count. Being aggrieved thereby, the appellant has filed the present Appeal which has been admitted and is to be heard finally.

Mr.R.S.Dave, the learned counsel for the appellant submits that as the appellant has passed away, during the

Tilak 2/2 (4)APEAL-997-12 pendency of the present Appeal, he does not wish to advance any oral arguments in support of the Appeal.

Under these circumstances, after having gone through the impugned judgment and after considering that no efforts to show how the impugned judgment is erroneous, have been made, I do not see any reason to interfere with the judgment and order of conviction as passed by the learned Special Judge. The Appeal is dismissed.
