I have gone through the report submitted by the learned Registrar. I have also gone through the report received from the trial court.
avk 1/4
While rejecting the previous application for bail filed by the applicant, by the order dated 2nd December 2014, this court had directed inter alia that the failure of the Police Authorities to produce the applicant and the other accused before the trial court on the dates of hearing, if any, be forthwith reported by the trial court to this court. It seems that the trial court has not reported the matter, inspite of such a categorical direction. The report submitted by the trial court is also not satisfactory, as it deals only with the happenings taken place on a particular date. Anyway, since Shri Kotwal submits that Charge has been framed and a date for recording of evidence has been fixed as 19th December 2015, the matter may not be probed into in further details, and it would be sufficient to direct the trial court to expedite the trial and endeavour to complete it within a period of six months from today.
In view of this, Shri Kotwal states that he does not wish to press the present application.
avk 2/4
The application is allowed to be withdrawn and stands dismissed as such.
Liberty to the applicant to apply afresh for bail, in the event of the trial not being over within the period of six months from today.
