This is an application for condonation of delay in filing an application for leave to appeal.
Heard the learned advocate appearing for the applicant. None appeared for respondent no.2, despite service. avk 1/2
20-APPLN-437-2016.doc Averments made on affidavit in the application for condonation of delay are to the effect that after receipt of the certified copy of the judgment and order of acquittal, the applicant approached his advocate for filing the appeal but his learned advocate informed that he does not take up the matter before this court. Hence, the applicant engaged an advocate practicing in Mumbai for challenging the judgment and order of acquittal and in this process delay of 35 days has occasioned. Averments made in the application are not controverted. Sufficient cause is made out. Hence the order : i) The application is allowed.
ii) Delay in lodging the application for leave to appeal is condoned.
