The Civil Application seeks condonation of delay of 168 days in institution of the appeal. However, till today no service is effected upon respondent Nos.1 and 2.

The appeal relates to the year 1998 and the total amount of enhanced compensation awarded by the Reference Court is Rs.1,683/- in its entirety. Taking into consideration the meager amount of compensation awarded by the Reference Court and for N.S. Kamble page 1 of 2
915-caf-3310-2001 the reasons set out in order dated 06 February 2017 in Civil Application No.5080 of 2001 in First Appeal Stamp No.12511 of 1999, the Civil Application and consequently the Appeal itself is dismissed.

It is made clear that the dismissal of this appeal is not to be taken as approval of the rate determined by the Reference Court insofar as other matters arising under the same acquisition notification are concerned.

The Civil Application and the Appeal is disposed of accordingly.
