The applicants have preferred this application for anticipatory bail. No such application was preferred before the Sessions Court. Learned advocate for the applicants submits that to avoid embarrassment for applicant no.4, the application has been preferred directly moved to this Court.

Taking into consideration fact that the Sessions Court has jurisdiction to entertain the application under section 438 of Cr.P.C, the applicants can prefer such an application for the same relief before Sessions Court.

The application stands disposed of. It is clarified that the Sessions Court would decide the application if preferred by the applicants on merits.
