IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION BAIL APPLICATION NO. 1772 OF 2020 Mohammed Nadeem Marchant @ Nadeem Chikna ..
Applicant
Versus
The State of Maharashtra ..
Respondent ...
Mr. Moin Khan for the Applicant.
Ms. A. A. Takalkar, A.P.P. for the State/Respondent. ...
CORAM: BHARATI DANGRE, J.
DATED : 7th SEPTEMBER, 2022 P.C:- 1.
On expressing my disinclination to entertain the present application, the learned counsel seek permission to withdraw the same.
2.
The counsel for the applicant is however perfectly justified in submitting that he came to be arrested on 28/03/2018, since he was arrested in some other case. Since the CR is of the year 2016 and one witness is already examined, I deem it appropriate to request the Special Court to conclude the MCOC case no. 9 of 2018 within a period of one year from today.
3.
In case the trial is not concluded, the applicant is at liberty to file a fresh application seeking his release on bail on the ground of long incarceration. Prefer an application before the Competent Court.
