After the writ petition was argued for some time, it emerged from the records of the High Court that some posts of Member, Industrial Court and Labour Court are still lying vacant. The earlier selection process is complete and when we indicated to Mr. Talekar that at this belated stage we are not inclined to interfere therewith, Mr. Talekar, on instructions,

suresh 906-WP-9001.2016.doc stated that the petitioner would withdraw the writ petition if in any fresh selection process he is found eligible to compete and his claim is duly considered in accordance with law. 2.

In the light of the above statement made by Mr. Talekar on instructions, we grant leave to the petitioner to withdraw the writ petition but with liberty to participate in any fresh selection process. We are sure that his claim would be considered if he is otherwise eligible and in accordance with law and that he filed a petition and highlighted the alleged shortcomings or defects in the earlier selection process will not be held against him.
