Mr.Thorat, learned counsel appearing for the petitioner seeks liberty to withdraw this writ petition with liberty to file an appeal under section 35(1A) of the Maharashtra Slum Areas (Improvement, Clearance And Redevelopment) Act, 1971. Writ petition is dismissed as withdrawn with liberty as prayed. It is made clear that this court has not expressed any views on the merit of the matter. All contentions of both parties on merits are kept open. Since the petitioner was pursuing this petition in this court and if any appeal is filed within three weeks from today, delay shall be condoned. If however application is not filed within three weeks from today, the appellate authority shall consider the delay independently on its merit. No order as to costs. [R.D. DHANUKA, J.]
