The parties have tendered the consent terms which are taken on record and marked as 'X' for identification. The consent terms are duly signed by the advocate for the petitioners. The consent terms are also signed by Shri Suresh Shinde, Deputy Manager of the petitioner who is authorised to sign the consent terms on behalf of the petitioner. I have interacted with Shri Suresh Shinde,

Deputy Manager who stated that he has signed on the consent terms. Shri Suresh Shinde is identified by Shri S. S. Lanke, learned counsel appearing on behalf of the petitioner. The consent terms are also signed by the respondent -Jagannath Sormare. Shri Jagannath Sormare produced original Aadhar card for perusal. The xerox copy of the same is taken on record and marked as 'Y' for identification. Though the consent terms are in English, the respondent - Jagannath Sormare submitted that though he does not follow English language, but the terms of the consent terms were explained to him. He agreed that there is settlement between the parties. The cheques totaling the sum of Rs.11,06,506/- are handed over to the respondent today in Court and he accepts having received the cheque of Rs. 11,06,506/-.

He submits and undertakes that in view of the settlement arrived at between the petitioner and respondent, he would not claim any amount against the petitioner. The consent terms were explained to him in Marathi and he submitted that he has signed the same voluntarily and on his own free will.

there is no pressure on him to execute the consent terms. The parties have agreed to abide by the consent terms. The writ petition is therefore disposed of in terms of what is stated in the consent terms. No order as to costs. (M. S. KARNIK, J.)
