P.C.:- The Appellant herein has challenged the order dated 15th June, 2015 wherein the learned Judge, City Civil Court, Dindoshi, Goregaon, Mumbai had granted ad-interim relief in terms of prayer clause (b) in Notice of Motion No.1146 of 2015 in S.C. Suit No.806 of 2015.

The learned counsel for the Appellant and the learned counsel for the Respondent submit that the pleadings in the motion are already completed and that the notice of motion itself can be disposed of in a time bound manner.

In view of the above statement, the appeal from order stands disposed of with directions to the learned Trial Judge to dispose of the motion within a period of six weeks from the date on which this order is uploaded. Ad-interim relief granted by order dated 15th June, 2016 to continue till the disposal of the motion. 4.

It is made clear that this Court has not gone into the merits of the matter and the learned Judge shall decide the motion on its own merits and in accordance with law. All the points and contentions of the respective parties are kept expressly open. (SMT. ANUJA PRABHUDESSAI, J.) Megha 2/2
