Heard learned counsel for the parties.

By this application, the applicant seeks modification of the condition of reporting imposed by this Court (Coram:Revati Mohite Dere,J.) vide order dated 1st October, 2015, passed in Bail Application No.1719 of 2013. The condition of which modification is sought reads as

2/3 under :- "14(ii). "The applicant shall attend the Kalachowky Police Station, A.T.S., once in a month on the first Saturday of every month between 11:00 a.m. to 12:00 noon till the conclusion of the trial." 3.

Learned Counsel for the applicant states that the applicant has been attending the concerned Police Station i.e Kalachowky Police Station, as directed by this Court, since his release. She states that the applicant is a resident of Srirampur, and as such he be permitted to attend the ATS Police Station, at Ahmednagar, instead of Kalachowky Police Station, ATS. She states that the applicant is ready to attend the trial Court on every date of hearing and will co-operate with the trial, even after the said condition is modified. She states that the applicant will not delay the trial. The said statement is accepted.

Learned APP does not dispute the fact, that applicant has been attending the concerned Police Station, as directed by this Court. She states that she has no objection if the said condition in para 14, clause (ii) is modified.

Considering the aforesaid, the application is allowed. The aforesaid condition i.e.14(ii), imposed vide order dated 1st October, 2015 passed in Bail Application No.1719 of 2013 is modified. The applicant shall now, attend the Ahmednagar ATS Police Chowky on the first Saturday of every month, between 11.00 to 1.00 p.m, instead of Kalachowky Police Station, ATS, till the conclusion of the trial. If the first Saturday falls on the date given by the trial Court, the applicant shall be exempted from attending the police station on that day.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
